Article 1: Applicability
These are the general terms and conditions (“General Terms and Conditions”) of Groovie Monkey (“Groovie Monkey”). These General Terms and Conditions apply to all orders placed through the Groovie Monkey website.
By placing an order you explicitly agree to the applicability of these General Terms and Conditions to your placed order and you declare to be familiar with their content.

Article 3: Agreement, price and payment
The agreement comes about when you place an order on the website and Groovie Monkey has sent a confirmation of your order by email.
Groovie Monkey reserves the right not to accept your order in the event:
The information you entered is not correct or complete and in the event that Groovie Monkey doubts the accuracy thereof;
You have not fulfilled a previous payment obligation;
You have not received and/or have not collected a previous order;
The delivery address you provided is located in a country where Groovie Monkey does not deliver.
Groovie Monkey will inform you as soon as possible about the non-acceptance of your order.
The price shown on the website at the time of payment is a total price of all products, including shipping costs and taxes applicable in the European Union.
You can pay your order through one of the payment options offered by Groovie Monkey.
Orders that are delivered outside the European Union, may be subject to additional fees and/or taxes. These surcharges and/or taxes are explicitly not included in the total price mentioned in paragraph 2 of this article. Any additional costs resulting from these surcharges and/or taxes are for your own account and risk.
Groovie Monkey cannot be held to an offer on its website if you can reasonably understand that the offer or any part thereof contains an obvious mistake or writing error, such as an unusually low price. We request you to contact Groovie Monkey if you have doubts about the accuracy of an offer.
Article 4: Delivery
Groovie Monkey will do everything possible to process and deliver your order as soon as possible, but in any case within 30 days after the purchase date. The indicated delivery dates on Groovie Monkey’s website are based on the circumstances known to {{Groovie Monkey}} at the time of the conclusion of the agreement and may be subject to change due to external factors, such as the chosen payment method, mode of transport and internal availability. The delivery date is also subject to change if you make changes to your order.
You are required to do everything that can reasonably be expected of you to enable Groovie Monkey to deliver your order on time. If you do not cooperate, as described in article 4 paragraph 2, BALR. reserves the right not to deliver the products.
Your order will be delivered to the delivery address or pickup point that you have indicated on the Groovie Monkey website.
Once Groovie Monkey has received your payment for the products ordered by you, the ownership of the products ordered will pass to you.
Groovie Monkey will do everything possible to deliver the products you ordered, complete and in good condition. If the delivered products are incomplete or damaged, please contact us as soon as possible.
Article 5: Faithful representation and life span
Groovie Monkey does its utmost to display the products on its website as faithfully as possible. If you believe that the product you ordered does not match the display on the website – at the time of ordering the product – you can use your right of withdrawal. Article 6 of these General Terms and Conditions describes how you can exercise your right of withdrawal.
The lifespan of the products Groovie Monkey offers on its website depends on the material of the product and the way and intensity with which you use the product. To ensure that the products have an optimal lifespan and quality, it is important that you follow the (washing) instructions.
Article 6: Reflection period and right of withdrawal
If you are not satisfied with your ordered product(s), you can dissolve the agreement within a reflection period of fourteen (14) days after receipt of the product in question without giving reasons (right of withdrawal).
The cooling off period begins the day after you received the product or on the day a third party designated by you (this is not the carrier) has received the product.
If you want to dissolve the agreement, you can do so at any time. You can use this model form and send it back to us. You can also register your return. Please return the items as soon as possible, but within 14 days from the day you have exercised your right of withdrawal. The product(s) in question can be sent to the address listed in Article 2 for product returns.
You are only liable for any depreciation of the goods due to processing other than what is necessary to assess the nature, properties and function of the goods. This means that all items must be returned in the same condition as when received; the items must not have been damaged, soiled, washed, altered or worn (other than for trying on) and all labels or tags must be intact.
If an item is eligible for a refund, Groovie Monkey will refund the amount paid for the item to the account number you used within fourteen (14) days of receiving the item in question.
You will receive a refund of the total amount paid (including standard shipping costs). If you have chosen a different shipping method (e.g. UPS Saver) than the standard shipping method, any additional charges for that other shipping method will not be eligible for a refund. If you return one or more items from your original order and the total value of the remaining items is less than the €100 threshold, we will charge shipping costs by mutual agreement. We do this by reducing the paid amount of the item(s) you returned by the shipping costs in your country. The return shipping is free of charge. The amount will be refunded via the original payment method used when placing the order.
The right of withdrawal is not limited by the terms and conditions for returns and exchanges, which you can consult via the website.
The right of withdrawal does not apply to the following type of contracts:
Contracts for the supply of goods made to the customer’s specification or clearly personalized.
Article 7: Vouchers
When using a voucher, no refund will be given if the total amount is not fully spent.

Article 9: Complaints
We do our utmost to ensure that the ordering and delivery process runs smoothly. If you still have a complaint, you can contact us via our contact details as stated in Article 2 of the General Terms and Conditions.
We strive to resolve your complaint as quickly as possible.
Article 10: Applicable law
Dutch law shall apply to these General Terms and Conditions and the agreement(s) entered into between Groovie Monkey and you. The applicability of the Vienna Sales Convention is excluded.
Article 11: Amendments to the General Terms and Conditions
Groovie Monkey may amend these General Terms and Conditions at any time. Amendments to the General Terms and Conditions are only effective when the amended version is published on the website of Groovie Monkey. We expect you to consult the most recent version of the General Terms and Conditions when purchasing products through our website.
